Whenever unsecured debts become too much to handle, you can count on a debt settlement lawyer for help. This person is an expert in finding ways to settle or address your unsecured debts, more specifically credit card debts.

Being stuck in a financial problem is a serious thing. A single, small money concern can escalate to multiple, bigger ones if not attended to right away. Credit cards are great financial tools for making purchases; but when credit card bills are left unmanaged, expect to be in a great financial dilemma. You may wake up one day with a large pile of payables particularly demand letters from credit card companies.

Most people do not seek expert legal advice unless they are already facing a foreclosure or worse, filing for bankruptcy. These are some of the most critical times to hire a debt settlement lawyer, who is often also a bankruptcy attorney. But such a move is necessary in order for debtors to get through all the legalities involving their financial circumstances.

Regardless of your level of income, consider getting professional help the moment you see signs of your debts piling up and getting out of control. The sooner you address your financial problem the better for you. Do not wait for your money concerns to go haywire.

Approach someone who has the experience and knowledge in helping you clear or settle your debts. The debt settlement lawyer has the means to ask your creditors to reduce your debt by up to about 65 percent.

He works hard to achieve as much savings for you mainly because his professional fees are a percentage, about 25 percent, of the reduced amount of debt. Nevertheless, he usually waives his fees in cases where savings do not amount to at least 25 percent of your total debt.

Although hiring a debt settlement lawyer may appear promising for you, beware of those who are only seeking to fill their own pockets rather than help you. Look for a legal professional with a good track record in handling financial issues.

A lawyer skilled at debt settlement and personal bankruptcy is what you need to negotiate with your creditors for more favorable and more manageable repayment terms. It pays to hire someone who is most capable of helping to increase your chances of reducing or settling your debts.

After all, it is never an easy experience to go through a financial turmoil but you can quickly rebound from it with the assistance of someone, like a debt settlement lawyer to whom you can entrust the financial aspects of your life.

How Debt Settlement Helps to Repair Your Credit Score

If you are keen to repair your credit then debt settlement can be a feasible option for you. With a debt settlement programs you can get rid of your delinquent accounts by repaying your all your outstanding amounts. This will help to boost your credit and repair it.

The settlement process helps to lower your principal balance along with the interest on it making it affordable to pay off your debts. You can either settle your debts on your own, or take the help of a professional negotiator to guide you in the negotiation process.

Here are some of the ways to boost your credit score:

1. If you default on your payments for many months then a settlement offer will be proposed by the credit card issuers. After six months of the delinquent account, the bank will write off the debts. However, before declaring it as a bad credit they will try to retrieve it.

They might ask you to repay an amount less than what you actually owe and consider it as payment in full. Once you have settled the owed amount then ask for a status of “paid as agreed” on your credit report. So, this can repair the damage on your credit report and remember that the final status of “settled” on your credit report can have a negative impact.

2. Your credit counselors will negotiate with your creditor to settle your debts and redesign a payment plan. Generally a counselor plans to prepare a new budget or teach money management skills depending on your financial situation according to the Federal Trade Commission (FTC) rules.

If this does not work out then he suggests a debt management plan. The counselor negotiates with the creditors to lower the interest on the principal balance or appeal for removing the late payment-fee charges. If you diligently follow the repayment plan then some lenders might “re-age” your account and repair damage from delinquencies.

3. Your payment determines your credit score. So, your past delinquent payments are responsible for your low credit score. According to myFICO scoring company, 35% of your score comes from your payment performance. Calculate the total amount that is due and start working out on a repayment plan to boost your credit rating. Pay your debt in lump sum to lower your debt as that determines another 30% of your score.

4. If you can remove the incorrect entries in your credit report then you’ll be able to repair your credit immediately. Once you get a free copy of your credit report from Experian, TransUnion and Equifax, check the report thoroughly. If you find any discrepancies, report to the credit bureau to remove the wrong entries from it.

7 Questions And Answers About Auto Loans

If you’re thinking about borrowing money for your brand new vehicle, here are 7 questions and answers about auto loans that you should be aware of.

Q1: – What is the biggest advantage in applying for an auto loan online?

The biggest benefit of making a request for an auto loan through the Internet is that the application process and decision making is easier and generally offers the chance to receive more ideal annual percentage rates. Also, you will be applying from the comfort of your own home. After submitting your online auto loan application, the auto lender will inform you within a few minutes if you have been approved or not for your auto loan.

Q2: – What are the basic requirements for applying for car financing?

1) You must be at least 18 years of age.

2) Your gross monthly employment income and other sources of income should be a minimum of $2,000 for a direct auto loan, but can be less when using indirect financing through the car dealer.

3) You need to show proof of residence history and employment history showing at least two years at the same residence and company.

Q3: – What is the difference between direct and indirect car financing?

Direct car financing is a cash voucher or draft approval from a financial lender for buying at a dealer of your choice. An Indirect car financing means you get financing from the car dealer.

Q4: - What is the difference between prime car loans and sub-prime car loans?

Prime car loans are for car loan applicants that have an excellent credit profile. Lenders offer appealing rates for prime applicants because they have proven that they can manage their credit. Sub-prime auto loans are for people who do not have excellent credit and usually the terms and rates are not as attractive prime car financing.

Q5: - Is it needed to choose my car before I apply for an auto loan?

It will be better not to select the car first since you should know the amount and price range that you can comfortably afford. Your first task is to apply for direct auto loan financing. Once you are approved, you will receive an electronic check for a maximum amount of money to spend, based on your current credit standing and your current debt-to-income ratio. You will simply complete the electronic check by filling in the amount for the cost of the vehicle.

Q6: – What are the factors that determine the annual percentage rate?

The annual percentage rate (APR) that you will pay for on your auto loan depends on several aspects. First, an applicant’s credit history determines the interest rate that will be associated with an auto loan. Furthermore, your interest rate also depends on loan term and on whether you are buying a new car or a used car (the year of the vehicle).

Q7: – How much is the down payment for the car typically?

If a down payment is required to purchase the car, they are typically 5-10%. The amount of the down payment is determined by your credit history also..If you have excellent credit history, you will pay less for the down payment in addition to the attractive annual percentage rate.

When does a collections agent over the phone cross over the line into harassment? Collection agencies are restricted from utilizing obscene language or threats of violence. However, they are allowed to insult your integrity and make you feel bad about the person you are.

Anecdotal stories that have surfaced are about collectors saying that a debt can’t be negotiated, settled or paid off more slowly. Bill collectors have been known to rudely demand when a debtor is going to pay, and then reject a debtors offer as not enough. This is not true or acceptable, as a consumer you always have the ability to negotiate.

Debt collectors work on commission which is why the persistent ones can be so aggressive and hostile. But the key point is that, despite that you may owe money to a creditor, you always have the right to be treated like a professional.

Even though collectors are prohibited from calling third parties such as co-workers, friends and family to spread the word that you are in debt, collection agencies are allowed to contact people who may know where you are if they are trying to find you.

Bill collectors are expressly banned from threatening you with jail time, however it has become a common tactic to use this threat to intimidate immigrant communities, because there is less of a chance that these people will know or understand the law.

A bill collector cannot call you repeatedly, which technically means that they can’t continuously call you over and over. Despite this fact, that does not stop them from calling you two, three, even four times a day. With some companies, bill collectors are given a small number of accounts to work with purposely so that they can badger a consumer in debt into paying for their commission.

To put a stop on collections phone calls, you are able to send a letter by certified mail return receipt requested requesting that they no longer contact you by phone.

Peer to peer loans work because they are traded on a marketplace, where individuals with money to invest can be in touch with people who need to borrow money.

It is said that “what goes around comes around”, and this couldn’t be more true when it comes to peer to peer personal loans. In the old days, banks and other lending companies did not even exist. If someone needed money to build something or expand a business, they would approach someone who had some money to spare.

It may not have been called it at the time, but this was the origin of peer to peer loans. Of course, as society grew more sophisticated, institutions were created with the specific purpose of lending money to people who needed it, earning a profit on that operation by charging interest on the funds lent.

Many times, these organizations were formed as savings and loans, so that they would receive savings deposits of individuals who wanted to receive a return on money they were not using. Banks or other financial institutions took advantage of this phenomenon by using the deposited funds and lending it to people who needed funds. The difference between what they paid their depositors and what they received from their borrowers became their profit.

The cycle has turned, and many people are now turning to peer to peer personal loans, which eliminate this middle man, making the transaction less expensive for both parties. The official name for this is disinter-mediation, since the intermediary of the bank is now removed.

Peer to peer loans work because they are traded on a marketplace, where individuals who have money they want to invest can be in touch with individuals who need to borrow money. Many times, these sites may take the form of auctions, where the lender can compete with other lenders for the borrowers they want.

Today’s consumer is very attuned to this concept due to marketplace sites such as eBay, but instead of hard goods or e-goods, buyers and sellers are actually dealing in money for sale. With no intermediary, a major cost is eliminated so that the lender can earn a higher rate, and the borrower can pay a lower rate.

Lenders especially like the notion of peer to peer personal loans because of the unique risk arrangement available. Lenders can split the funds they lend (their investment) into many small personal loans to various individuals, which means that each individual may receive his money from a variety of lenders.

Let us say that you would like to borrow $1,000 to buy an engagement ring for your girlfriend. There may be someone on the peer to peer lending site who is looking to lend $1,000. But what will happen is that the lender of $1,000 prefers to only lend $100 to you for your dream purchase. He will find someone else, who is perhaps planning to use his personal loan to consolidate overall debt and lend him $100, and then find someone else who plans on needed repairs to his home and lend him $100, and so on.

Now this investment of $1,000 has been lent to 10 different people, lowering his overall risk, since the chances of all of his borrowers defaulting on their personal loans is very small. The converse benefit for the borrowers is that they have many more lenders bidding for their personal loan business.

Part 1 – What Will A Good Credit Counselor Do For You

* * * * *

One good thing that you could do is go to various news sites and key in a search term like “credit counselor” or “credit counseling” and see what comes up. One thing for sure is that what you read is pretty current, sometimes only hours old. That’s what I have done. Recently there is been criticism of how some credit counselors act when trying to win you over to sign up with them.

Some of the criticism surrounded issues as to their effectiveness as well as to their legality. On the other hand you will also find those honored for leadership in Consumer Credit Counseling Services.

But, as mentioned criticism still abounds, so the Federal Trade Commission filed lawsuits against several credit counselling agencies, and they continue to urge caution to consumers when it comes to choosing a credit counselling agency.

The FTC has received over 8,000 complaints from consumers about shady credit counselors. Many of those complaints concern high or hidden fees along with the inability to opt out of so-called “voluntary” contributions. The Better Business Bureau also reports high complaint levels about credit counselling.

The FTC and Better Business Bureaus are not the only ones. Credit counseling services also touched the nerves of The Internal Revenue Service (IRS). The have denied tax-exempt status of many credit counseling agencies. Although only roughly thirty agencies were involved, they still account for more than half of the industry’s revenue.

The lobby against credit counselors arises from the belief by the collection industry that the not-for-profit status of the credit counselors gives them an unfair financial and market advantage over them. The IRS apparently agrees.

Although it has yet to be proven, it seems that the tax exempt revocations revolve around whether or not a tax exempt credit counselor really performed as they were supposed to. Instead it is speculated that they devoted their attention to their own debt management plan customers in a “collection practice“.

But, as with everything else on this planet there is The Good, The Bad, and The Ugly about Credit Counseling Services. There are some very good credit counselors that have great reputations while there are also some that love to take advantage of consumers. Where some agencies charge excessive fees and provide poor service, others are just plain frauds.

The Federal Trade Commission really had enough of this and have cracked down on con artists who target jobless Americans. If you are looking for fantastic information go check out The National Foundation for Credit Counseling – (NFCC). Being a member of the NFCC can go a long way to eliminating abuses by non-member credit counseling companies.

Debt Consolidation Companies

Although similar to credit counselors, debt consolidation companies negotiate with your creditors to try and get a lower pay-off amount for your debts and then try and secure a loan on your behalf. If successful, this will allow you make a single payment rather than several payments. The big difference with debt consolidators is that they really only do one thing – they will charge you a fee to get your creditors to accept a lower payment and then get a loan for you to pay them off.

But if you think about it, you can do this yourself. All you need to do is a little bit of work by calling your creditors and negotiate a pay-off balance yourself. When you go to your bank to get your loan, you tell them that the loan is a debt consolidation loan. Even if your credit is less than perfect, many banks have debt consolidation loans available to most people.

(NOTE: If you’re a private student attending university or college you may want to check out www.PrivateStudentConsolidationLoan.org)

When deciding on whether you want to see a credit counseling company or or a debt consolidation company, all you need to do is research all the advantages and disadvantages of each and how they relate to you. Once this is in place, narrow your research further by determining their reputation. Do some online research and go to the NFCC and see if they are a member of the National Foundation for Credit Counseling. Above all make sure they have a good reputation.

Yes, debt consolidation and credit counseling services can help you get rid of your debt but you need to be cautious and DO YOUR HOMEWORK or you could end up with more problems than just too much debt.

Assuming you have already found a good credit counselor to help you pay off your debts, you will want to know the process they will go through so that they act in your best interests.

Process #1

First off the credit counseling service will contact your creditors and start negotiating with them to create a debt management plan specific for your needs. The goal of a successful plan set up by your counselor is to help you to repay your debts with the aid of a repayment plan with your creditors.

If successful, the debt management plan would consist of:

- lower monthly payments

- lower fees

- and, of course, lower interest rates for you

Your credit counselor will refer to the terms dictated by your creditors in order to determine the payments or interest reductions offered within the debt management plan.

Once you agree to the repayment plan, your creditors will close your accounts and restrict them to future charges. Your main benefit of seeing a credit counselor in the first place is for them to consolidate all your monthly payments into one single monthly payment. As they say - “the whole is better than the sum of its parts”.

This one single payment may seem quite large, but if you add up each of your regular payments to each creditor separately, you will find that they add up to more than if you just had to make a single payment.

Banks that offer credit cards will usually accept lower monthly payments from their customers through a debt management plan as they know it would be tougher for them if they were to make payments on their own without any counselor’s assistance.

Although some debt management plans advertise that their clients can save as much as 50% in monthly payments, the average reduction is usually between 10% and 20%

Process #2

Another major benefit to having a debt management plan in place for you is the reduction in interest rates that you would have to pay to your creditors. If your credit card happens to be in default, the interest rates that you could be paying may approach upwards of 30%.

However, by seeing a credit counselor that can negotiate a good debt management plan for you, it is possible to secure interest rates in the 5% to 10% range, especially for bank credit cards. Heck, you may even be able to get the interest charges eliminated completely.

Negotiating a reduction in interest rates also benefits the counseling agency because they are able to advertise that their customers can be debt free in much shorter time periods. So, if it would normally take 20 years to pay off your debts, the credit counselor should be able knock about 15 years off of that payment schedule. This is very significant and an attractive advantage if your debts are quite high.

Process #3

If your debts happen to consist of delinquent accounts, your credit counseling agency will proceed to make those accounts “current”. This is often called “re-aging” or “curing” an account. This usually occurs after making a series of on-time payments through the debt management plan as a show of good faith and commitment to completion of the program.

For example: – a client with an account that has a monthly payment of $50 but that monthly payment has not been paid in two months, might be considered by the creditor to be 60 days past due. After agreeing to the debt management plan and you make three consecutive on-time monthly payments, your creditor could “re-age” the account to reflect a current status.

This is good news because the credit bureaus would be notified that your account is now current. With this in place, your credit rating has now just been improved. However, you should also know that this process does not eliminate prior delinquencies from the credit reports.

At least this will give you some breathing room as it gives you the chance for a fresh start and for the opportunity to start building a positive credit history. Like all negative credit information, only the passage of time will lessen the impact of negative marks when credit scores are calculated.

Another thing to remember is that you still need to pay the credit counseling company for services rendered. After all, they are a company and they need to make some sort of income. You need to be aware of the amount of fee and agree to it before you sign on the dotted line.

Because the credit counseling company knows that you are in a financial bind, the fees they charge are usually not that high. This is where you need to do your homework and find a counseling service that’s right for you. Where the credit counselors are compensated the most is from the creditors themselves. This has led to speculation that credit counselors are actually just sub-department of the creditors themselves.

With the recent downturn in the economy, many people are realizing that they cannot afford to sustain the lifestyle that they have grown accustomed to living. Fortunately, this does not mean life cannot be enjoyable. There are a number of easy ways to live within your means without hurting your quality of life. With a little planning and knowledge you can live on budget without feeling the financial strain.

The following are a number of ways to live within your means while making life more enjoyable:

1. In order to live within your means, you have to be able to bring in more money than you are spending.

Create a monthly budget that includes how much you spend on essential items such as home and vehicle insurance, utilities, food, cable, phone, mortgage payments, gas, etc. Then, calculate how much you earn monthly. Subtract your monthly income from necessary expenses to determine how much extra money you have to work with.

2. List extra expenses – such as entertainment, recreation, and products you shop for in the home and on yourself such as clothing, personal care products, etc.

Calculate how much you spend monthly on these items. You will then need to come up with ways to control your spending habits. This can include cutting down on the number of times you dine out each month, shopping for discounts at large department stores, second hand stores, surplus stores, etc. When shopping, look for deals, coupons, and sales. Never pay full price for an item. As well, you can often find great deals when shopping online.

3. Credit card debt is a major source of financial hardship.

If you have several credit cards with high outstanding debt, you should at least pay the monthly minimum for each card, and then start to pay off the card with the highest interest rate. Owning fewer credit cards will make it easier to manage and remember.

Always pay your bills on time to avoid having to pay any interest at all. To help wean yourself off of credit cards, start carrying cash with you at all times and pay using cash. Seeing the physical money literally change hands will help you consider needs vs. wants on a more regular basis.

4. If you are having trouble keeping up with debt payments, then maybe you should consider consolidating your debt in order to manage it better.

Instead of making multiple monthly payments to several creditors, you can consolidate your debt and only need to make a single monthly payment. In addition to helping you get organized, this can also alleviate stress that is often associated with debt.

5. Clean up your credit score.

Request a copy of your credit report from one of the following two major credit bureaus: Equifax, or TransUnion. Check it over for any inaccuracies. Look to see what debt is affecting your credit rating and work with a creditor to establish a repayment plan. Don’t ignore your creditors as they will send your debt to a collection agency.

At first, implementing a plan to live within your means can seem very unpleasant. You may miss a few of the luxuries you had grown accustomed to. However, once you get used to the plan, you will find life more enjoyable as you will not longer have the worry of how you are going to pay all of your bills. You may even realize that you are much happier living on a budget.

Yup, there are some myths about debt consolidation that the banks don’t want you to know. Some may shock or even anger you, but it is a message that must be told. For example, you probably think you can’t do it yourself and you NEED a professional agency to do it for you. That couldn’t be further from the truth. I did it and so can you! Let’s dive into some of the most common myths people have about credit repair.

Myth 1: – I Can’t Do It Myself

We need help once in a while and why not. Credit repair and debt consolidation is an area where you can do it by yourself. Back in the days when I saw my credit report for first time I saw some “bad marks” on it (you know some late payments and stuff) I start freaking out and remember to think “there is no way I can do this by myself. I will need some professional help“.

Nevertheless I did it myself. How? Easy! I got educated. That is the key.

And now you are going to get the best education possible on this subject about how to:

- consolidate your debt

- repair your credit

- maintain your credit score, etc.

While I was studying my credit report I realized some big mistakes by either the creditor, the credit bureau or both!!.

These were not my mistakes at all, I found several mistakes in multiple accounts and some research indicated that anywhere from 75% to 90% of the credit reports contained errors.

Myth # 2: – You cannot fix your bad credit.

Wrong. Just because you have bad credit doesn’t mean that you can’t repair it. It may take longer to fix, but it is repairable. There are many fast ways to restore your credit, build positive lines of credit, and get yourself back on the right track to good credit.

If you think a 520 is bad-it is. I was turned down by every credit card I applied for. I even got denied at Banana Republic in front of 20 people at Christmas time. Yeah, no fun. If I can do it, so can you. It’s just a matter of becoming educated.

Myth #3: – You just have one Credit Score.

You have 3 credit scores, not just one, each credit score is from the major credit reporting agencies – all 3 will show different scores, that is why when applying for credit, one company may use one report while another company may use a different one. It is always a good idea to get the 3 reports from the different bureaus because they can have serious differences.

Myth #4: – Checking Your Credit Will Lower Your Score

There are different types of inquiries:

- soft inquiries

- and hard inquiries

The hard inquiries are the ones that will affect your credit score and these are done from the companies you wish to get the credit from. The other inquiries does not affect your credit score and those are the inquiries where you just want the information for promotional purposes.

Myth # 5: – Your score will be lower if you are shopping around for a Loan.

This is one of the most common myths. Remember that if you are looking for credit from several vendors (mortgage, car loans, home loans, etc…), all these inquiries will appear in your credit report just once. However, remember that this applys if the same kind of inquiry is made within 14 days. The only exception to this rule are credit cards.

The myth # 6: – Removing negative items is the only way to improve my score.

This is a partial true, because “erasing” your bad marks is just one piece of the credit repair puzzle. Remember that while removing “negative items” will help you in your credit score, just building “positive credit” will take your score further. Do you remember when you were denied a credit card because you did not have credit? The truth is that you did not have positive credit built up with the credit card companies.

Free advice about credit cards: How To Reduce Your Credit Card Interest Rate With One Simple Phone Call

Here is a sweet little trick: Get on your telephone and dial your credit card company number and ask them to drop your interest rate! It’s that simple!. Just tell them that you have in front of you a credit card with a lower interest rate. It may be that they are offering you a zero percent rate for the first 6 months and after that period they will charge you 8%.

Tell them that you are thinking of transferring your entire balance to this new company if they don’t decrease your interest rate. Chances are that you will get a better interest rate than the one you have right now. Be extremely kind with the operator, but if you can’t get a deal ask to talk to their supervisor. Just remember that the key is to treat them with respect.

Needing a good credit counseling service and actually finding a good service are two different matters. So, how can you find a good counseling service you can be happy with?

The first thing you should check is that they belong with the BBB, the Better Business Bureau. When looking at their website look for the BBB logo and make sure that it links to the Better Business Bureau. When you go to the BBB site to check out a credit counseling service, find out if there are any unresolved issues or complaints against them.

One thing to keep in mind is that a lot of people only go to the Better Business Bureau after they have a problem with the credit counseling agency. Preventing future headaches by checking with the BBB “before” any trouble begins will always be to your benefit. This makes it easier for the Bureau to mediate any disputes you may have with the service.

In many cases, if the credit counseling service is a reputable firm, they will be accredited by an independent non-profit company like the “National Institute for Financial Counseling Education.

A good credit counseling agency will charge a small, reasonable monthly fee, usually around $30. Some also charge a fee upfront, though this fee should be reasonable (around $50 tops). It may be possible to get a hardship waiver of these fees if you truly do not have the small amount of funds available.

Once you’ve made your choice, you will need to fill out one of their application forms. Make sure you read that application. It must clearly say:

- what the fees to be paid are

- what the services to be provided are

- and in what time frame the services will be provided

FAIR WARNING – If the organization proposes to “wipe out” the debts for you, then run away as fast as you can. A good credit counselor should only HELP YOU to repay your debts. On the otherhand, if your creditor just decides to forget about your debts, then right on – go for it. But this is highly unlikely.

Debts are not very easy to erase. Even if you declare bankruptcy, your credit report will have a big bad mark on it for ten whole years.

If your debt consists mainly of unsecured loans like credit cards, then one advantage (if that’s what you want to call it) is that your possessions won’t get taken away. If the debt is made up of secured loans, like home mortgages or automobile loans, you could end up walking to work and sleeping under a tree.

Either way, you are still legally obligated to repay your debts, and the possibility of being taken to court will be forever a part of your dreams until it’s taken care of. It may even become harder to get “bad credit” financing if you still have outstanding debts that are not taken care of.
